Terms and Conditions

1. Introduction
Welcome to SmartCare Professional Nanny and Homecare Services (“the Agency”). By using our services, you agree to these terms and conditions. Please read them carefully before engaging with our agency.
 
2. Services Provided
• We offer nanny placement services, including comprehensive recruitment, labour outsourcing, payroll solutions, and ongoing support.
• Our services are tailored to meet your specific needs and preferences, as agreed during the consultation process.
 
3. Fees and Payment
• All fees for our packages must be paid in full before the commencement of services.
• A non-refundable placement fee is required to initiate the process.
• Additional charges may apply for specialized services or requests, the rates for outsourcing solution may vary accordingly
 
4. Candidate Selection and Replacement
• The Agency ensures all candidates are thoroughly screened, trained, and vetted.
• If a candidate is unsuitable, a replacement will be provided as per the terms outlined in your package.
• Replacements are subject to the terms of our guarantee period (e.g., within 90 days of placement).
 
5. Client Responsibilities
• Clients are responsible for providing accurate information during consultations.
• The Agency is not liable for any miscommunication or issues arising from incomplete or false information provided by the client.
 
6. Confidentiality
• Both parties agree to maintain the confidentiality of personal and professional information shared during the placement process.
 
7. Liability
• The Agency conducts thorough background checks and assessments; however, SmartCare will not liable for actions of the placed nanny beyond our screening process.
• Clients who are contracted to our outsourced solution will have protection in the form of insurance, and all employees of SmartCare will be covered by insurance and be registered for workers compensation accordingly. 
 
8. Termination
• The Agency reserves the right to terminate services if the client violates these terms or engages in inappropriate behavior.
 
9. Dispute Resolution
• Any disputes shall first be addressed through mediation before pursuing legal action.
• Service Level agreements and employment contracts will be in accordance with the Basic Conditions of Employment Act, no 75 of 1997.
 
10. Amendments
• The Agency reserves the right to modify these terms at any time. Updated terms will be communicated to all clients.
